Ministry of Economy and Sustainable Development declined the JSC Poti Sea Port administrative clime on annulment of the Order # 92-04 of May 30, 2019 by the LEPL Technical and Construction Supervision Agency of the Ministry.

On May 02, 2019, the LEPL Technical and Construction Supervision Agency approved (with the Ordinance #77-04) the terms of use of the plot of land for the construction of the new deep water multifunctional port located to the north of the Poti Sea Port and on May 30, 2019, the Agency annulled this decision with the Ordinance #92-04, which was based on the written position provided by the LEPL National Agency of State Property confirming that the state-owned plot of land requested by the Poti Sea Port (and for which the LEPL Technical and Construction Supervision Agency previously approved the terms of use) included territorial waters and such land is affected by the special legal regulations.

Existing legislation considers the National Agency of State Property to be a significant body, which is empowered to take part in the decision-making process on state-owned immovable property as well as take decisions on its own. Consequently, the fact that the National Agency of State Property was against the decision to allocate the above mentioned plot of land to the Poti Sea Port for its further development and construction of the new deep sea port and relevant facilities became the solid bases for annulling the LEPL Technical and Construction Supervision Agency Ordinance #77-04 on the terms of use of the plot of land for the construction of the new deep water multifunctional port.
